This paper examines Robert Nozick's Anarchy, State, and Utopia in the light of the myths and fictions upon which it is built. I hold that it is possible to identify two main myths: the Lockean state of nature, whose principle can be summarized by the maxim volenti non fit injuria, and the libertarian meta-utopia, that can be explained as an application of Hayek evolutive theory and of Popper's epistemology in order to construct an utopia. I also claim that there is a continuity between both myths, and that this continuity is granted by a moral intuition that Nozick presents at the beginning of this work, and that also inspires the libertarian myth: that life can only have sense when each person is allowed to live her own in the way she deems convenient.

He is best known for his books Philosophical Explanations , which included his counterfactual theory of knowledge, and Anarchy, State, and Utopia , a libertarian answer to John Rawls' A Theory of Justice There, Nozick argues that only a minimal state "limited to the narrow functions of protection against force, theft, fraud, enforcement of contracts, and so on" could be justified without violating people's rights. For Nozick, a distribution of goods is just if brought about by free exchange among consenting adults from a just starting position, even if large inequalities subsequently emerge from the process. Nozick appealed to the Kantian idea that people should be treated as ends what he termed 'separateness of persons' , not merely as a means to some other end. Nozick challenged the partial conclusion of John Rawls' Second Principle of Justice of his A Theory of Justice , that "social and economic inequalities are to be arranged so that they are to be of greatest benefit to the least-advantaged members of society. Most controversially, Nozick argued that a consistent upholding of the non-aggression principle would allow and regard as valid consensual or non-coercive enslavement contracts between adults. He rejected the notion of inalienable rights advanced by Locke and most contemporary capitalist-oriented libertarian academics, writing in Anarchy, State, and Utopia that the typical notion of a "free system" would allow adults to voluntarily enter into non-coercive slave contracts.

That is, Rawls depicts bargainers as separate consumers , entitled to separate shares , while dismissing the separateness of what they do as arbitrary. Part II continues to pound on the incongruousness of respecting our separateness as consumers see his discussions of distributing grades and mates while implicitly denigrating and even denying our separateness as producers. Part III argues that true utopia would not impose a favored vision of utopia while silencing incompatible rivals. It would instead be a cooperative society for mutual advantage, premised on everyone coming to the table with a robust right to say no to unattractive offers. To support the idea of the minimal state, Nozick presents an argument that illustrates how the minimalist state arises naturally from anarchy and how any expansion of state power past this minimalist threshold is unjustified.
